Shut down factories without registered boilers within 60 days: HC
The High Court (HC) on Tuesday asked the authorities concerned to shut down the industries running without boiler registration within 60 days.
A two-member HC bench comprising Justice Jubayer Rahman and Justice M Ikbal Kabir passed the order on July 10 after the primary hearing of a writ petition. The written copy of the order was published on Tuesday, reports the UNB.
The court also issued a rule asking the authorities concerned to explain why it will not direct to compensate the boiler-blast injured, to take punitive actions against those have been using defective boilers, to declare illegal the inactivity and failure of the concerned persons to keep workplace safe and to tackle boiler-blast injuries.
The rule also includes why it will not be directed to promulgate rules under section 28 and 29 of Boilers Act 1923 to prevent boiler-blast accidents.
Industries Secretary, Textile and Jute Secretary, Labour and Employment Secretary, Law Secretary, Disaster Management and Relief Secretary, Home Secretary, the chief boiler inspector and chief factory inspector were asked to reply to the rule within three weeks.
Apart from, the court also asked the Industries Ministry to visit industries for checking boiler registration and renewal process and submit a report in this regard within September 30.
On July 9, Supreme Court lawyer Mahfuzur Rahman Milon, also the executive director of human rights organisation Justice Watch Foundation, filed the writ petition seeking a court order to lodge a new case against the owner of Multi-Fabs Ltd, a garment factory at Kashimpur in Gazipur, in connection with the death of its 13 employees in a boiler blast.
On the following day, the HC bench passed the order and issued the rule.
On June 3, 13 workers were killed and around 50 others injured as a boiler went off at the dying section of the factory.
On the following day, a case was filed against 13 people excluding the name of factory chairman Mohiuddin Faruki and other officials.
Later, Supreme Court lawyer M Saifur Rahman sent a legal notice to file a case against the owner and the manager of the factory and arrest them within 24 hours on July 5.
