Tarique’s mother-in-law challenges ACC case

Dhaka: Syeda Iqbal Mand Banu, mother-in-law of BNP senior vice-chairman Tarique Rahman, has filed a writ petition with the High Court challenging the legality of the graft case filed against her by the Anti Corruption Commission (ACC).

In the petition filed on Monday, Banu sought a stay on and cancellation of the case proceedings, and HC directives on the ACC to issue a fresh notice on her for submitting wealth information, said ACC lawyer Khurshid Alam Khan.

The petition was kept in the list of the bench comprising Justice M Enayetur Rahim and Justice Amir Hossain for hearing on Tuesday.

However, Banu’s counsel AJ Mohammad Ali prayed to the court for not hearing the petition this week. The bench is likely to hear the petition next week.

On 20 January, ACC deputy director RK Majumder, also investigation officer of the case, submitted a charge sheet against Banu to the court of Metropolitan Magistrate Shamsul Arefin.

On 14 January, the ACC approved the charge sheet against Banu on the basis of a probe report submitted to the commission by its official.

On 30 January 2104, ACC deputy director RK Majumder filed the case with city's Ramna Police Station against Syeda Iqbal Mand Banu for not submitting the wealth statement to it in time.

Later, the commission approved the filing of the case against Banu since she did not submit her wealth statement to it within the deadline.

Two years ago, on 25 January 2012, the national anti-graft body served a notice asking Banu to submit her wealth statement to it. But the High Court stayed the operation of the ACC notice responding to a writ petition filed by Banu challenging its validity.

Upon an ACC petition seeking an opportunity for leave-to-appeal, the Appellate Division of the Supreme Court overrode the High Court stay order in September in 2013.
