Submit affidavit of explanation, SC orders Fakhrul

Dhaka: Rejecting a plea to submit it through his lawyer, the Appellate Division of the Supreme Court on Monday ordered the BNP leader to submit the explanation of his remarks about the judiciary as an affidavit on Tuesday.

The apex court also fixed Tuesday for the hearing on his ‘leave-to appeal’ against an High Court order that granted him limited bail in three violence cases.

A five member Appellate Division bench, headed by Chief Justice SK Sinha, gave the order after turning down the plea of Fakhrul’s lawyer Advocate Zainul Abedin to present the explanation on behalf of his client.

Advocate Zainul Abedin told reporters that they could not file Fakhrul’s explanation in written form due to time shortage and the court have asked for submitting it as an affidavit on Tuesday.

Earlier on 18 February, the SC asked the BNP leader to explain his recent remarks on the judiciary during a hearing on the petitions filed by Fakhrul seeking bail extension in three violence cases filed against him with Paltan Police Station in the capital.

The court fixed 22 February for passing orders on his petitions and also directed the BNP leader to submit his explanations by the same date.

Speaking at the council of Sylhet city unit and district unit BNP in Sylhet on 7 February, Fakhrul had accused the government of controlling the judiciary.

‘All the democratic institutions have been destroyed in a planned way. There's no democracy in the country and the judiciary is not independent,’ he said.
