Dhaka: The Appellate Division of the Supreme Court on Thursday cleared the way for taking steps based on the notices issued by Anti-Corruption Commission (ACC) against two top Destiny officials seeking their wealth statements.

A five-member Appellate Division bench, led by Chief Justice SK Sinha, issued the order after staying the High Court order that had stayed the effectiveness of the two notices issued by the anti-graft watchdog against Destiny Group managing director Rafiqul Islam and Destiny-2000 Ltd chairman Mohammad Hossain seeking their wealth statements, reports UNB.

Following the SC order there is no legal bar to take measures against them as per the ACC notices seeking their wealth statements, said ACC lawyer Khurshid Alam.

Barrister Azmalul Hossain QC stood for the petitioners.

Earlier, on 2 August, the High Court had stayed the effectiveness of the two notices issued by the ACC to the Destiny Group managing director and Destiny-2000 chairman.

Following two writ petitions, an HC bench comprising Justice Mohammad Ruhul Quddus and Justice Bhishmadev Chakrabortty also issued a rule asking the authorities concerned to explain why the notices should not be declared illegal.

On 15 June, the ACC served notices to the Destiny Group MD and Destiny-2000 chairman, seeking their wealth statements within 15 days.

Following separate petitions, the ACC extended the time by seven days.

Later, both the Destiny officials filed separate writs with the High Court challenging the legality of the ACC notices.
