Writ filed against Qamrul, Mozammel for breach of oath

Dhaka: A writ petition was filed with High Court against two ministers—Qamrul Islam and AKM Mozammel Huq—challenging the legality of holding their respective posts even after the Supreme Court’s observation that they violated the oath of office.

Supreme Court lawyer Yunus Ali Akand filed the petition with the relevant section of the High Court on Monday.

An HC bench of Justice Moinul Islam Chowdhury is expected to hear the petition on Tuesday next.

Earlier on Saturday, a legal notice was served on the two ministers—Qamrul Islam and AKM Mozammel Huq—to explain on what authority they are still holding their respective posts even after the Supreme Court’s observation.

The lawyer sent copies of the notice to the offices of the two ministers by registered post.

It was mentioned in the notice that a writ petition will be filed against them with the High Court if they fail to respond to the notice within 24 hours.

The Supreme Court on Thursday released the full text of its verdict that fined Qamrul Islam and AKM Mozammel Huq Tk 50,000 each on 27 March last for their controversial comments about Chief Justice SK Sinha in connection with the war crimes trial against Jamaat-e-Islami leader Mir Quasem Ali.

On 14 March, ministers Qamrul Islam and Mozammel Huq offered unconditional apology to the court for their remarks.

On 8 March, the Supreme Court summoned the duo to appear before it on 15 March for their reactions to the remarks of Chief Justice SK Sinha about the prosecution as regards the trial Mir Quasem Ali in a war crimes case.

Qamrul and Mozammel had demanded resignation of the Chief Justice for his reported remarks that ‘the prosecution is doing politics with the trial of condemned war criminal Mir Quasem Ali’.

They made the demands at a roundtable discussion organised by Ekattorer Ghatak Dalal Nirmul Committee in the city on 5 March.
