SC upholds order to resume Pollen murder trial

Dhaka: The Supreme Court on Monday upheld a High Court order that cleared the way for a lower court to resume the trial of a case filed for the murder of Mymensingh Girls’ Cadet College student Sharmila Shaharin Pollen.

The four-member bench of the Appellate Division of the Supreme Court passed the order rejecting a petition filed by an accused Maj Nazmul Haque.

Earlier on 6 April, the High Court cleared the way for a lower court to resume the trial proceedings of the case.

Later, the accused filed the petition for scrapping the trial proceedings.

After completing hearing of the petition on Sunday, the SC fixed Monday to deliver the verdict on the petition.

Lawyer Khandaker Mahbub Hossain stood for Pollen while Barrister Rokon Uddin for the accused and additional attorney general Murad Reza for the state.

Khandaker Mahbub Hossain said that now there is no bar to resume the trial.

On 11 February, 2005, police recovered the body of Sharmila Shaharin Pollen, 18, a second year student of the college and daughter of Abul Bashar Patwary, from her dormitory.

On 19 February, victim’s father Patwary filed a case against some unidentified people with Mymensingh District and Judge Court in this connection.

On 3 March, 2016, a Mymensingh court framed charges against five people for their alleged involvement in the killing, following a judicial probe report submitted by magistrate Al-Amin.

Later, four of the accused filed a petition with the High Court seeking cancellation of the charge-framing.

The accused are: the then adjutant Maj Nazmul Haque, the college’s associate professor Abul Hossain, the then sergeant Nawsher-uz-Zaman, the then security guard Hena Begum, and the then deputy adjutant general Maj Monir Ahmed Chowdhury of the Army Headquarters.

One of them remains absconding.
