Dhaka: The Appealed Division on Monday extended for six weeks its earlier order asking BNP acting secretary general Mirza Fakhrul Islam Alamgir, now staying in the United States for treatment, to surrender before lower court in three cases.

A four-member bench of the Appellate Division, headed by Chief Justice Surendra Kumar Sinha, passed the order after the hearing on a petition filed on behalf of Fakhrul.

Zainul Abedin and Sagir Hossain Leon appeared for Fakhrul while Attorney General Mahbubey Alam stood for the state.

Earlier on 23 August, a petition was filed with the SC seeking extension by eight weeks its earlier order asking Mirza Fakhrul to surrender before lower court in three cases.

The Appellate Division on 13 July upheld the High Court bail for six weeks to the BNP acting secretary general in three cases related to street violence.

A four-member bench of the Appellate Division, headed by Chief Justice Surendra Kumar Sinha, passed the order considering the necessity of Fakhrul’s advanced treatment abroad.

The SC came up with the order after receiving a report from a five-member medical team, comprising two surgeons of vascular surgery, a respiratory medicine specialist, a medicine specialist and a cardiologist, formed by Bangabandhu Sheikh Mujib Medical University Hospital (BSMMU) authorities on the health condition of the BNP leader.

The court also asked Fakhrul to surrender to the trial court before expiry of the bail.

Six months after his arrest, the BNP leader who has been facing a number of cases relating to political violence, was released from jail on 14 July.

He went to Singapore on 26 July for treatment. Later on 10 July, the BNP secretary general left Singapore for the United States for better medical treatment.

On 6 January, plainclothes police picked up Fakhrul as he came out of the Jatiya Press Club after nearly 25 hours of stay there following BNP’s announcement to observe January-5 as ‘Democracy Killing Day’, protesting the 10th parliamentary polls held on the day.
